1. Overview of the Service

The Company provides automated privacy-management and rights-exercise services, including but not limited to:

  • Data Removal Requests: Submitting data deletion, objection & restriction of processing to data brokers, marketing databases, and other third-party organisations included in the guardID service on your behalf.

  • Spam Postal Mail Opt-Out: Submitting do-not-mail and suppression requests intended to reduce unsolicited physical (“spam”) postal mail, flyers & other advertising media.

  • Spam Phone Call / Fax Opt-Out: Submitting do-not-call/fax and suppression requests intended to reduce unsolicited phone calls & faxes.

  • Content Ownership Protection: Assisting you in asserting ownership of your original content, sending notices to third parties instructing them not to use your content for AI model training or automated data-collection, and documenting or registering such claims where applicable.

The Service operates exclusively on your authorization and on a best-effort basis. We cannot guarantee that all organizations will comply with opt-out, deletion, or ownership requests.

2. Spam Marketing and Opt-Outs

We provide optional services to reduce unwanted mail, door-to-door deliveries, and unsolicited calls/faxes. You are only enrolled in these services if you are an annual member & explicitly select during the sign-up process, or if you amend your preference once a member.

2.1 Royal Mail Door to Door Opt-Out
  • Opting out stops all unaddressed mail from being delivered by Royal Mail.

  • Royal Mail may still deliver important government or public-interest messages.

  • You may still receive mail from non-Royal Mail distributors.

  • You cannot separate wanted from unwanted mail.

2.2 DMA-Member Door-to-Door Distribution Companies
  • We share your name and address with DMA-member companies (excluding Royal Mail and local newspaper publishers) to stop unaddressed mail.

  • Registration lasts two years; if you remain a member, we will reapply automatically.

  • Your request must include your full address and you must be over 18 with approval from all other adult household members.

  • The address must be personal and not shared with other households.

  • You may continue to receive mail from non-DMA distributors, local newspapers, charities, or government communications.

  • Allow up to 24 weeks for distribution companies to process your request.

  • Your details will be held by distribution companies and may be verified.

2.3 Mail Addressed to Your House
  • We may share your details with the Mailing Preference Service (MPS) to stop addressed marketing mail from member businesses.

  • It may take up to 6 months to fully take effect.

2.4 Unsolicited Phone Calls and Faxes
  • We may share your details with the Telephone Preference Service (TPS) and Fax Preference Service (FPS) to reduce unsolicited calls/faxes.

  • All phone numbers you provide will be registered.

2.5 User Confirmations for Spam Opt-Outs

By selecting any of these services, you confirm:

  • Your address is personal and not shared with other households.

  • You are over 18 and have approval from all other adult household members.

  • You understand you may continue to receive mail from non-participating distributors, including government or local authority communications.

3. Eligibility

To use the Service, you must:

  • Be at least 18 years old to sign up to the plan, under 18’s can be added on the family plan if the primary member is parent or guardian of all children added to the plan,

  • Be legally capable of entering into a binding contract,

  • Have the lawful right to request removal, suppression, or ownership enforcement for the data or content submitted, and

  • In the case of mail suppression have consulted all persosn living at the address that they agree to adveriting mail being supressed that is delivered by Royal Mail, the Data & Marketing Association or members of the Mailing Preference Service.

4. User Authorisation
4.1 Acting as Your Agent

By using the Service, you authorise the Company to act as your agent in communications with third parties regarding your personal data, unsolicited postal mail, and intellectual-property rights requests.

4.2 Submitting Requests on Your Behalf

You authorise the Company to submit rights requests in your name, including deletion, suppression, access, correction, and ownership-enforcement notices. This may include signing documents or electronic submissions on your behalf where required for verification.

4.3 Sharing Your Personal Data With Third Parties

You expressly authorize the Company to share the personal data you provide with third-party organizations solely for the purposes of:

  • Determining whether those organisations store or process any of your personal data, and

  • Submitting, verifying, and facilitating data-deletion or suppression requests on your behalf.

Only the minimum necessary information will be shared, and solely for these purposes. Your data will not be provided to third parties for marketing, analytics, or AI training.

5. User Responsibilities

You agree that:

  • All information and content you provide is accurate and legally yours to control.

  • You will not use the Service to make fraudulent, unlawful, or unauthorised requests.

  • You will promptly notify the Company if you discover inaccuracies in any submitted information.

  • For content ownership claims, you represent and warrant that you own the content or are otherwise legally authorised to assert rights over it.

6. Limitations of the Service
6.1 No Guarantee of Outcome

The Company cannot guarantee that all data brokers, organisations, or content-host platforms will comply with deletion, suppression, or ownership requests. The company will make all best endevours to ensure organisations delete or otherwise abide by the requests we make on your behalf.

6.2 Third-Party Compliance

While third-party organizations ultimately control whether they comply with your requests, the Company will take all reasonable, lawful, and industry-standard steps to encourage and facilitate compliance. This includes:

  • Making follow-up submissions,

  • Providing additional verification or documentation when required,

  • Escalating through available internal processes of the third party,

  • Making complaints on your behalf to regulators & supervisory authorities,

  • Citing applicable legal obligations when appropriate.

However, the Company is not responsible for non-compliance by third parties.

7. Subscription, Billing, and Cancellation
7.1 Automatic Renewal

Subscription renews automatically unless canceled.

7.2 Refunds

Refund eligibility is governed by our Refund Policy. Your statutory rights may vary by jurisdiction.

You may cancel at any time through your account settings. Work already completed cannot be reversed.

8. Intellectual Property
8.1 User Content

You retain ownership over all content you submit, excluding where you have ‘Shared Intel’ made a report of a company or organisation you wish guardID to add to the list of third-parties they request deletion from, in which case you grant guardID the right to use this intelligence in perpetuity at no cost.

8.2 License to Provide the Service

You grant the Company a limited, revocable, non-exclusive license to use your content solely to provide the Service, including ownership-protection and rights-enforcement activities.

8.3 No AI Training

The Company does not use your personal data or submitted content for AI model training, dataset generation, or any automated analysis unrelated to providing the Service.

9. Privacy

Use of personal data is governed by our Privacy Policy. By using the Service, you consent to the collection, processing, and sharing of your data as outlined in these Terms and our Privacy Policy.

10. Prohibited Use

You may not use the Service to:

  • Violate the rights of others,

  • Submit fraudulent or defamatory ownership claims,

  • Misrepresent your identity,

  • Harass or threaten third parties, or

  • Engage in any illegal activity.

We may suspend or terminate access for violations.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee uninterrupted availability of the Service or successful outcomes for any request as this replies on organisations doing as required (by law) when we request deletion.

12. Limitation of Liability

To the fullest extent permitted by law:

  • The Company is not liable for indirect, incidental, punitive, or consequential damages.

  • Total liability for all claims shall not exceed the amount paid by you to guardID during the six (6) months preceding the claim.

13. Indemnification

You agree to indemnify and hold the Company harmless for any claims arising from:

  • Your misuse of the Service,

  • Inaccurate data you provide,

  • False or unauthorized ownership claims, and

  • Your violation of these Terms.

14. Termination

We may suspend or terminate your access if:

  • You violate these Terms,

  • Your requests appear unlawful or fraudulent, or

  • Required by law or regulatory authority.

No refund will be given for unused membership if your access is suspended or terminated due to this clause.

We may update these Terms from time to time. Continued Membership and / or continuted use of the Service signifies acceptance of any updates.

16. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England. You agree that the courts of England shall have exclusive jurisdiction to settle any dispute, claim, or legal action arising from or relating to these Terms or your use of the Service. Data Shared for Member Requests

When you subscribe and become a member you are asking us to get your data deleted, restrict its processing, or object to use, we will need to share your details with the companies or organisations involved solely for the purpose of carrying out that request.
We will clearly instruct them to never use that data for anything else.

We may also share relevant contact details with Royal Mail, the Direct Marketing Association (DMA), and the Mail, Telephone, or Fax Preference Services when members request suppression — again, only to action those specific requests and prevent unwanted contact.

If you apply or have applied for a role to work with us we will delete your details (if sadly unsuccessful) within 2 months unless you want us to retain your details for opportunities in the future.

Furthermore I also authorise guardID to take any other actions aimed at enhancing my digital privacy & personal data sovereignty and the following specific action(s) on my behalf in addition to those laid out elsewhere in this document:

Register my current address with Royal Mail's 'opt out' scheme.
Register my current address with the Data & Marketing Association's 'Your Choice' scheme.
Register my phone (& fax) number(s) with the Telephone Preference Service & Fax Preference Services.

Moreover, I authorise guardID to contact companies involved in Artificial Intelligence, Machine Learning, or other emerging technologies to inform them that I expressly withhold and / or withdraw my consent for the use of any content, works, or materials I have created.
